Terms and conditions of supply

These terms and conditions apply to the use of our website www.fonehub.co.uk

By using this website you agree to be bound by these terms and conditions whether or not you place an order. If you disagree with these terms and conditions, you will not be able to use our website or place an order.

Please note that we may revise these terms and conditions at any time by updating this page. We advise you to consult them regularly as they are binding on you once you place an order, these terms and conditions.

Customer obligations

By placing an order through our website or registering with us, you warrant that:

  • You are a resident in Great Britain or Northern Ireland or based there for a business. At our complete discretion we may accept or reject orders from people outside of these territories.
  • You are legally capable of entering into a contract.
  • For individuals: You are over eighteen years of age or have obtained your parent's or guardian's consent to sell your phone if you are under 18 years of age. If you breach this terms, you and your parents release us of any liabilities or claims that may arise.
  • For businesses: You are authorized to act on behalf of the registered business.
  • You own all rights, title and interests of any phone(s) you send to us.

Working Phone(s)/Gadget(s)

Each mobile phone you sell should match the brand and model you indicated when you place your order and meet the following conditions:

Grade Conditions

A

Full Amount
Must be pristine, with no blemishes and have the appearance and workings of a new device.

B, C

Working - Average

Re-Offer (up to 50%)
Must be fully working, power up and have no faults, cracks, chips or missing parts. No LCD pressure burn or dead pixels. Must be in full working order, no software faults, or hardware issues. No cracks or severe damage to the screen or outer housing. Average wear and tear acceptable. Must be able to make calls, accept a UK SIM and have a working Wifi. No faulty charging ports or swollen / water damaged batteries or handsets.

D, E, BER

Faulty - Poor:
Re Offer
Handset will be classed as faulty if, but is not limited to: The device has a software fault, is cracked, broken or bent or has any missing parts. Handsets with no Power or screen image will be returned. Will Power On, will have, but is not limited to faulty software, faulty button(s), faulty Wi-Fi, faulty LCD, faulty charging port, faulty speaker, faulty microphone, heavy scratches, cracked or smashed screen, damaged or heavily warn casing. Non genuine parts. Heavy wear and tear, also includes heavily worn device casing (metal / plastic), will be re-classified as a Grade D. May have software issue, water damage, cracked or smashed screens and be faulty. Device will not power on / The same value will be given to all iCloud locked devices – you will be contacted for these.

Brand New Phone(s)/Gadget(s)

To qualify for our Brand New Phone price your phone must meet all the criteria listed below:-

  • The screen seal is present and has not been tampered with.
  • There are absolutely no marks or scratches on the phone.
  • All accessories are present and unopened.
  • The original box is in good condition.
  • The IMEI on the box matches that on the phone.
  • Call timer on the phone is zero and there is no data inside the phone.
  • No calls have been made or received.
  • The Box of the phone should be of original manufacturer, not generated or white box.
  • The phone should not be at any case a refurbished or a reconditioned one.
  • Memory card should be included if supplied by the manufacturer of service provider.

Should you have any doubt, contact us before sending in your phone.

We do not accept stolen or barred phones. We check all received phones via Check Mend (a crime protection database) before confirming your order. Should we find out at any stage of the order that your phone is stolen, we reserve the right to withhold or cancel payment. By placing an order through our website, you agree to co-operate with us and any authorities should we so request, we will pass them to the relevant authorities along with the name and contact details of the customer.

We recommend you to remove all data prior to sending it in to us. We are neither responsible nor liable for the security, protection, confidentiality or use of such data. By sending your mobile phone to us you agree to release us from all and any claims, losses or damages with respect to the data stored or contained therein or on any media used in conjunction with the mobile phone.

Be aware that we will not accept liability or responsibility if a SIM card or a memory card is lost and charges are incurred before or after reception. You shall continue be liable for such charges.

You are responsible for cancelling any airtime contract linked to each handset. We are not responsible for any call costs that may be incurred arising before, or after, receipt of your handset, or arising from any other circumstances whatsoever.

By submitting an order through our website you warrant that the phone(s) comply with these terms.

Badly damaged casing /housing/ Broken/ damaged or Non-working phone(s).

Once we receive your phone(s) it will be checked by one of our engineers, in case the phone(s) is physically damaged/crushed/damaged casing or if any of its functions are not working properly, phone(s) will be classified as a Non-working/broken phone. We will send you an e-mail with a revised offer for your phone(s). In case you are not happy with our revised offer, we are happy to return your phone(s) back, delivery charge will be applicable.

Wrong model

If a phone fails to meet our terms and conditions we will:-

  • Confirm the correct mobile phone by email for you to accept the revised offer. Change your order according to the condition or the model of phone(s) that you have sent us.
  • Propose an adjusted price by email. If you choose to decline our new offer, we are happy to return the phone. A delivery charge will be applicable.

If we do not hear from you within 2 working days we will automatically make this change and process your payment on the new model.

Returns

Once you have posted a phone to Fonehub, it will not be possible to return it or any accessories for any reason so please make sure really want to send it to us. Mobile phones will be returned to customers only if a lower price is offered and rejected.

Please ensure you remove SIM and memory cards before sending us your mobile. These will be destroyed upon reception and we will not be able to return them.

Return Policy

In case of a revised offer being offered for your mobile phone(s) and you are not happy to accept, we are happy to return the mobile phone(s) back to you through Royal Mail. Customers are now responsible for the delivery charges if they want there phone(s) return back to them.

Royal Mail Recorded Delivery - £5.00. Its provide a tracking number and a compensation of up to £50.00 in case of any loss or damage to the post.

Royal Mail Special Delivery - £10.00. Its also provides a tracking number but a compensation of up to £500.00 in case of any loss or damage in the post..

Posting

Please note that it can take up to 5 working days for your phone to reach us. Fonehub does not accept responsibility or liability for non-delivery of phones or damage in transit. We recommend you to pack your phones in a jiffy bag or bubble wrap it to minimize the risk of damage. You are responsible for insuring your postage. Thus we recommend sending high value handsets via registered post (for e.g. Royal Mail Special Delivery post insures your phone up to £500).

Prices

All prices indicated on our website include VAT (where applicable) at current rate. They may be changed without notice at any time. We will use our reasonable endeavours to provide our customer the 'Best Price' for their used mobile. However, this is not a guarantee. We shall not be held liable under any circumstances regarding price pledges.

Note that the price may change if the returned handset is different to the quoted handset regarding the brand, model, accessories or conditions. Once you order is confirmed, you have 7 days to send us your phone. After this period, we reserve the right to change the price reflecting the new market price if relevant.

All the prices are solely for individual customers, for traders prices may vary.

We will use our reasonable endeavours to provide our customer the 'Best Price' for their used mobile. However, this is not a guarantee. We shall not be held liable under any circumstances regarding price pledges.

Payment

Once we receive your phone(s) and it meets our terms and conditions, we will send you a cheque same day (Monday to Friday working hours apply) via Royal Mail first class.

Payments will only be made to the name and address you entered when you registered.

Please note that we are neither liable nor responsible for any failure to perform or delay in performance of our obligation if it is cause by events outside our control.

Accuracy of Information

We will use our reasonable endeavours to provide accurate information regarding the products, price, images, colours on the Site; However, due to the extent permitted by applicable laws, we do not assure that the descriptions, text, colours, contents or other images on the Site are comprehensive, error-free and completely accurate.

Warranties and Disclaimers

Everything on the Site is presented "as is" and "as available" without warranty of any kind whatsoever. The information, contents, products descriptions, colours, services and other data may not be in the most updated versions or may include omissions or errors.

You agree that, to the fullest extent permitted by any applicable law, we shall not be responsible or liable, whether in contract.tort.negligence or otherwise, for any interruption of business, access delays or data non-delivery, mis-delivery, destruction or other modification, loss or damages of any kind incurred in the Site under any circumstances.

We shall not be in any way liable for any direct, indirect, incidental, special or consequential damages, data or use, incurred by you or any third party arising from any access to, reliance on or use of the Site. We reserve the right in our sole discretion to make changes to any part of the Site or the services available at any time with or without prior notice.

Indemnification

You agree to defend, indemnify and hold us harmless for any loss, damages or costs; its advertisers, licensors, subsidiaries and other affiliated companies and their employees, contractors, officers, agents and directors from all liabilities, claims, and expenses, including attorney's fees, resulting from your use of the website or the Site Content or your breach of these terms and conditions, including without limitation any third party claim, action or demand.

We hereby reserve all our rights at our expenses, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which you shall cooperate with us in asserting any available defence.
